1. Definitions
The terms used in these Terms carry the meanings set out below:
- "Platform": the Munasek website and cloud platform, including all of its engines and tools.
- "Company": Munasek, the entity operating the platform and providing its services.
- "User": any natural or legal person who accesses or uses the platform, including engineering offices, developers, and government entities.
- "Outputs": any audit report, planning scenario, credit memorandum, or analytical result generated by the platform.
- "Project Data": drawings, CAD files, title deeds, parcel data, and other information you upload or query within the platform.
- "Agreement": these Terms, the Privacy Policy, and any additional policies published by the Company on the platform.
2. Acceptance of Terms
Accessing or using the platform in any manner constitutes full acceptance of these Terms. If you do not agree with any provision, you must stop using the platform immediately.
When using the platform on behalf of an organization (engineering office, developer, government entity), you represent that you are fully authorized to bind that organization to these Terms, and you remain personally liable for any misuse.
3. Service Description
Munasek is a Saudi cloud platform unifying the real estate development lifecycle in one pipeline. Its services include, without limitation:
- Comprehensive regulatory pre-audit of drawings against the Saudi Building Code (SBC), Civil Defense requirements, Balady municipal bylaws, and sectoral ministerial standards.
- Generation of spatial planning scenarios with computed floors, GFA, and FAR.
- Cadastral land and GIS boundary retrieval from authoritative records.
- A cloud CAD editor with an intelligent drafting agent.
- Feasibility studies and bank-credit modeling (loan capacity, IRR, DSCR, credit memos).
The platform evolves continuously; the Company may add, modify, or retire features without compromising the acquired rights of paying subscribers.
4. Accounts & Registration
Access to the services requires an account, and you are responsible for:
- The accuracy of your registration information (name, email, organization details, Saudi Council of Engineers license where applicable) and keeping it current.
- Keeping credentials confidential and notifying the Company immediately upon detecting any unauthorized use.
- All activity that occurs under your account.
Sharing an account between multiple users, and selling or assigning credentials, is prohibited. Violation may lead to account suspension per Section (11).
5. Acceptable Use
You agree to use the platform in compliance with the laws of the Kingdom of Saudi Arabia. You must not:
- Upload drawings or data you have no right to use, or that infringe third-party intellectual property or professional confidentiality.
- Attempt unauthorized access to the platform or other accounts, or tamper with audit mechanisms and logs.
- Run excessive automated access (scraping or bots) without a written agreement with the Company.
- Resell or distribute platform outputs as a standalone product without a Company license.
- Use the platform for any purpose that violates Saudi regulations or regulatory authority policies.
6. AI Outputs & Reliance Limits
The audit, scenario, and advisory features run on artificial intelligence. All outputs are first-draft decision support, not decisions. The platform operates on three principles:
- Drafts, not decisions: every output (audit report, scenario, credit memo) requires qualified human review before adoption.
- Human-in-the-loop: no drawings or reports are submitted to authorities without review and sign-off by a licensed engineer.
- Verify before reliance: you are responsible for verifying output correctness against the latest applicable codes and regulations.
Outputs may contain errors, omissions, or outdated information. Do not treat any output as final engineering or legal advice without independent verification.
7. Engineering Liability & Professional Sign-Off
Munasek is an enablement and acceleration tool for engineering offices and developers, and is not a substitute for licensed engineering review. The platform does not issue permits or official approvals, and does not bear responsibility for design, the accuracy of uploaded data, or the decision to submit outputs to authorities — these remain with you and/or your licensed representative under Saudi regulations.
8. Regulatory Compliance
The platform is designed to support conformity with the Saudi Building Code (SBC 201/501/801), Civil Defense requirements, Balady municipal bylaws, and sectoral ministerial standards. The Company does not claim any official certification or conformity approval from these authorities; final compliance responsibility rests with the project owner and their licensed engineering representatives.
9. Intellectual Property
The platform, its trade names, logos, code, and models remain the exclusive property of the Company. You receive a limited, non-exclusive, non-transferable license to use the platform for your lawful professional purposes during your subscription.
You retain intellectual property ownership of the drawings and files you upload, and your title deeds and land data remain yours. Our license to use them is limited to operating the service and improving the models as detailed in the Privacy Policy.
Your project data is used for model training only after removing identifying data, and you may refuse this entirely under the Privacy Policy without any effect on your account or its features.
10. Subscriptions & Payments
The platform runs on a credit system with subscription plans as shown on the pricing page. The following rules apply:
- Prices, plans, and details are shown at signup, denominated in Saudi Riyals, and subject to VAT as required by law.
- Subscriptions renew automatically unless cancelled before renewal, with advance notice of material price changes.
- The free trial plan is for evaluation only and must not be used for production or commercial workloads.
- Access may be suspended when credits are exhausted or payment is overdue, without affecting your data, which remains recoverable upon resuming the subscription.
11. Third-Party Services & Data Sources
The platform may rely on external providers for hosting, databases, cadastral land data, and AI models. The Company commits to selecting providers offering protection equivalent to the regulatory requirements of the Kingdom, and notifies users of material changes in these dependencies as described in the Privacy Policy.
12. Limitation of Liability & Warranty Disclaimer
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness of outputs for a particular purpose, acceptance by authorities, or uninterrupted availability.
To the maximum extent permitted by law, the Company is not liable for indirect or consequential damages, loss of profits or opportunities, project delays, or fines. Total liability, whatever the cause, is capped at the subscription fees paid during the twelve months preceding the event.
13. Suspension & Termination
The Company may suspend or terminate your account for breach of these Terms or use that endangers platform security or other users, notifying you of the reason unless legally or technically prevented. You may close your account anytime via platform settings or by contacting support; the data-retention policy in the Privacy Policy applies to post-closure data.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the Kingdom of Saudi Arabia. The competent Saudi courts — principally those in Riyadh — have jurisdiction over any dispute arising from or relating to these Terms, after exhausting amicable settlement within thirty (30) days of notice to the other party.
15. Changes to Terms
The Company may update these Terms. The updated version is published on this page with a revised effective date, and material changes are announced to subscribers via the platform or email sufficiently in advance. Continued use of the platform after the effective date constitutes acceptance.
